INFORMATION NOTE REGARDING THE PROCESSING OF PERSONAL DATA CARRIED OUT BY STRONG MND CORPORATION S.R.L

1. PURPOSE OF THIS DOCUMENT
This document aims to inform, in accordance with art. 13 of the General Data Protection Regulation (hereinafter “GDPR”), the data subjects (Partners – unauthorized individuals, representatives of legal entities) on how their personal data is processed from the perspective of national and European legislation (Law no. 190/2018, Law no. 506/2004, Regulation 2016/679/EU, Directive 2002/58/EC) in force. STRONG MND CORPORATION S.R.L (which we may also refer to as “we”) is obliged to manage the personal data provided to it in a secure manner and only for the specified purposes.

This information note applies to our activity on the website. We will be present on the website www.spartan.ro, in its subdomains or affiliated sites that we will call “site”.

In relation to the data processed on the website from individuals, we are personal data controllers, and in this capacity, we are obliged to establish the purposes and means of processing personal data, as well as to exercise all due diligence to process the data in compliance with technical and organizational measures.

3. WHAT PERSONAL DATA DO WE PROCESS?
Evaluation of your application for available positions within our company.
Data collected: Name, surname, contact details, professional experience, education, skills, other relevant information from your CV.
Legal basis: Your explicit consent expressed by submitting your CV and contractual subject matter.
Recipients: Human Resources Department and relevant managers within the company.

Storage duration: Your data will be kept for the duration of the recruitment and selection process, subsequently being deleted or anonymized, unless you have given your consent to keep them for future opportunities.

Management and resolution of your complaints related to our products or services.
Data collected: Name, surname, contact details, details about the complaint.
Legal basis: The company’s legitimate interest in managing and resolving customer complaints.
Recipients: Customer Relations Department and other relevant departments involved in resolving the complaint.
Storage duration: Your data will be kept for the period necessary to resolve the complaint and subsequently for a reasonable period of 6 months, for the purpose of recording and improving our services.

Assessing your eligibility to become a franchisee and managing the franchise granting process.
Data collected: Name, surname, contact details, information about business experience, financial situation, other information relevant to the assessment of the application.
Legal basis: Your explicit consent expressed by completing the franchise application form and contractual basis.
Recipients: Company management and other relevant departments involved in the franchise granting process.
Storage duration: Your data will be kept for the duration of the evaluation process and subsequently for the contractual period in case of franchise granting.

Billing data:
Data collected: e-mail address, telephone number;
Legal basis: contractual basis (email, to send the invoice), legitimate interest (telephone – contact if the company data is incorrect or the invoice cannot be sent).
Recipients: accounting department, to send the invoice.
Storage period: one month from the request;

Technical data: IP address, browser type and version, location and time zone settings, browser plug-in, operating system and other technologies on the devices used to access the site.

We will not collect any special categories of personal data intentionally, and if from the interactions you have, you wish to disclose such data, we will not record them and we will not take them into account.

4. LEGAL BASIS ON WHICH WE PROCESS PERSONAL DATA
The legal basis for data processing, depending on the activity carried out is described below:

Legal basis – for tax information;
Contractual basis – for submitting applications, for completing the franchising procedure;
Improving services and resolving complaints – legitimate interest.
Consent – ​​by participating in raffles and competitions, uploading photos and videos.

5. PURPOSES OF PROCESSING
The purposes for which we process personal data concerning you are the following:

Conclusion of the contract between the parties – we will use the data news and services provided by SPARTAN, intended for its users;

OPERATOR – represents the companies that come together under the SPARTAN brand name;

WEBSITE – means the website http://www. spartan.ro;

SECTION – means a section on the websites http://www. spartan.ro/;

SPAM – means any unsolicited commercial communication prohibited by law as long as there is no explicit consent from the recipient (user). SPARTAN does not encourage SPAM and will not proceed with such communications to its users;

STORAGE – keeping data or information on any kind of support;

USER – is any natural person who browses the website and views the content on it under certain conditions, without having to register with an account name and password;

VISIT – means any access by a person to the website http://www. spartan.ro/ or a subsection thereof;

PROCESSING OF PERSONAL DATA – any operation or set of operations that is performed on personal data, by automatic or non-automatic means, such as collection, recording, organization, storage, adaptation or modification, extraction, consultation, use, disclosure to third parties by transmission, dissemination or in any other way, joining or combining, blocking, deletion or destruction;

USE OF THE WEBSITE
The USER will be able to browse the website and view its content, being responsible for all accesses or visits made to the website by him, regardless of whether they are authorized by the USER or not.

Also, where applicable, the USER agrees to:

(i) provide true, accurate, current and complete information about him/her, and

(ii) maintain and promptly update the information provided so that it is accurate, current and complete.

If he/she provides any information that is false, inaccurate or incomplete, or SPARTAN has reasonable grounds to suspect that such information is false, inaccurate or incomplete, SPARTAN has the right to refuse any request and/or not to comply with requests, at its sole discretion.

The data and information provided by the USER are subject to the Privacy Policy and the Personal Data Protection Policy.

By using the site by the USER, he/she agrees to the collection and use (as set out in the Privacy Policy and the Personal Data Protection Policy) of certain information about the USER, including the transfer of such information for storage, processing and use by S.C. STRONG MND CORPORATION S.R.L. and its work points.

SPARTAN is not liable for any damage caused or in connection with the theft of data due to the USER’s inability to take reasonable measures, the USER’s disclosure of the data provided or the USER’s authorization granted to another person to use the USER’s data.

CODE OF CONDUCT APPLICABLE TO THE USE OF THE WEBSITE
In connection with the USER’s use of the website as well as in connection with the content that the USER completes as a user in the contact form made available by SPARTAN agrees that it will not proceed with the following actions nor will it allow anyone, directly or indirectly, to:

communicate, transmit or make available any content or information that it does not have the right to make available in accordance with any law or contractual provision;
communicate, transmit or make available, non-public information or personally identifiable information of another person, without the express consent of that person;
communicate, transmit or make available, information that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party in any other way;

transmit any content or information that is unlawful, fraudulent, threatening, abusive, libelous, defamatory, obscene, pornographic, hateful, vulgar or otherwise infringing on SPARTAN’s or any third party’s rights, intellectual property rights or other rights; transmit any material or information that is not public regarding commercial companies without authorization to do so; transmit any trade secret of a third party; or transmit any unsolicited advertisements, solicitations, investment opportunities or other commercial communications – also known as SPAM messages (except as otherwise expressly permitted by SPARTAN);
use the site to harm minors in any way;
transmit any software or other materials that contain viruses or other elements of a destructive nature;
modifying, adapting, translating, selling, or disassembling any part of the Site or attempting to derive any source code or underlying ideas or algorithms from any part of the Site;
removing any copyrights, trademarks, or other proprietary rights contained on the Site;
engaging in online harassment;
creating links to any page or content on the Site without prior written authorization from SPARTAN representatives;
using any robot or manual or automatic device to retrieve data or reproduce information or the navigation structure or presentation of the Site or content without SPARTAN’s prior written consent, including with respect to any image displayed on the Site;
harvesting or collecting information about site visitors without their express consent;
violating any applicable local, national, or international laws, including, but not limited to, any statutory regulations, as well as European regulations.
The actions presented above will constitute a violation of these “Terms and Conditions”.

Also, by accepting these “Terms and Conditions”, the USER declares that he/she has understood that the transmission and technical processing of the site, including user content, may involve transmissions through various networks and modifications to comply with and adapt to the technical requirements for connecting to networks or devices existing today in the online environment.

If the USER chooses to submit any ideas, suggestions, documents and/or proposals within the contact form made available by SPARTAN, he/she acknowledges and agrees that:

the USER’s messages do not contain confidential or protected information;
SPARTAN is not and cannot be liable for the content of the messages transmitted;
SPARTAN is not bound by any confidentiality obligation, explicit or implicit, with respect to the data provided;
SPARTAN shall have the right to use or disclose (or choose not to use or disclose) such communications for any purpose, in any media throughout the world; messages and information transmitted by the USER shall automatically become the property of SPARTAN;
USER shall not be entitled to any compensation of any kind from SPARTAN under any circumstances.

INTELLECTUAL PROPERTY RIGHTS and RESTRICTIONS ON USE
Subject to compliance with these “Terms and Conditions”, the USER may use the Materials solely for personal, non-commercial use, provided that no copyright or other proprietary rights contained therein are removed.

Subject to compliance with these Terms and Conditions, you may use the Site and the Materials solely for your own personal use provided that you do not use, reproduce, modify, display, distribute, create derivative works from, or circumvent any technological measure that effectively controls access to the Site and/or Materials in any way, including, without limitation, manually or automatically, for any purpose.

USER agrees that the Site is protected by copyright, trademark and other laws. Furthermore, he/she confirms that he/she does not acquire any ownership rights, byuse of the Site or the Materials, that it will not contest in any way that would affect SPARTAN’s ownership of the Site and its content.

The trademarks, logos and service marks displayed on the Site (collectively, the “Marks”) are registered and unregistered trademarks of SPARTAN and its SPARTAN PARTNERS.

SPARTAN’s proprietary trademarks, whether registered or unregistered, may not be used in connection with any service not offered by SPARTAN, in any manner that is likely to cause confusion among customers, or in any manner that disparages SPARTAN.

Nothing on this Site should be construed as granting, by implication, estoppel or otherwise, any right to use any trademark without the express written permission of SPARTAN or its SPARTAN PARTNERS.

Improper use of any Trademark is prohibited, and SPARTAN will enforce its intellectual property rights in such trademarks in accordance with the legal provisions, including through civil and/or criminal litigation.

By these “Terms and Conditions” the USER completely, irrevocably, and forever releases SPARTAN and waives any claim or demand that he may have against SPARTAN with respect to such links or third-party sites.

MINOR ACCESS
SPARTAN encourages parents to use appropriate parental supervision to determine whether to grant authorization to minor children to access the Site. Protections that provide parental control (such as hardware, software or filtering services) are commercially available, which may assist the USER in limiting access to material that is harmful to minors.

VIOLATION OF TERMS AND CONDITIONS. DAMAGES.
Breach of these “Terms and Conditions”, including unauthorized use of the site, may be investigated and action may be taken against them, including but not limited to civil, criminal or other proceedings.

THE USER understands and agrees that it remains at the sole discretion of SPARTAN, and without prior notice, that SPARTAN may restrict or block the USER’s access to the site or the services offered by it, that it may cancel certain events, may refuse to honor certain ongoing services or future services related to the USER or to a person acting in concert with the USER, if SPARTAN considers that the “Terms and Conditions”, the rights of SPARTAN, its partners or the rights of another visitor or site are violated.

SPARTAN will attempt to resolve the User’s issues as soon as possible, taking into account a reasonable period of time.

LIABILITY
Within the legal limits, the USER expressly agrees and assumes that neither SPARTAN nor the entities that make up this brand, their associates, their suppliers, collaborators or representatives are and will not be held liable to the USER or any third party for any incidents, consequences, direct or indirect damages (including but not limited to loss of business, loss of data or information or loss of profit) under any contract or negligence in connection with the site or the materials presented on the site.

ADVERTISING

SPARTAN newsletters are transmitted through the entities that make up the SPARTAN brand. Thus, the confidentiality and security of the information are ensured.

When the USER completes the contact form provided by SPARTAN, he has the opportunity to express his agreement to receive the Newsletter. The option regarding the agreement issued by the Client can be modified at any time by completing the unsubscribe form provided on the main page, also called the “Home Page”.

Opting out of receiving the Newsletters does not imply waiving the acceptance given for the present “Terms and Conditions”.

PRIVACY POLICY
The confidentiality of USER data is very important to us, therefore, all USER personal information will remain confidential.

SPARTAN will not sell, distribute or disclose information about its visitors without their prior consent and will not use the images, photos or videos of users without their prior consent.

Information of any nature provided by the User to SPARTAN will remain the property of SPARTAN.

By submitting information or materials through this site, the USER grants SPARTAN unrestricted and irrevocable access to them, the right to use, reproduce, display, modify, transmit and distribute these materials or information. The USER also agrees that SPARTAN may freely use, in its own interest, these ideas, concepts, know-how or techniques that it has transmitted to it through the Site.

SPARTAN will ensure the confidentiality of the USER’s data, if applicable, respectively of the data entered in the form made available by SPARTAN, more specifically the name, surname, e-mail, telephone number, as well as other details in connection with the message transmitted on the site, in accordance with the Privacy Policy and the Personal Data Protection Policy.

However, it is the USER’s responsibility to ensure that the information provided and transmitted on the site remains confidential at all times and that it will not be transmitted to third parties. By accepting these “Terms and Conditions”, the USER agrees to inform as soon as possible if he/she reasonably suspects that the security of the USER’s data is at risk.

PERSONAL DATA PROCESSING POLICY
Pursuant to Decision No. 200 of 2015 on establishing the cases of processing for which notification to the National Supervisory Authority for Personal Data is not required, SPARTAN is exempt fromto the obligation to notify the supervisory authority.

However, although it is no longer necessary to notify the National Supervisory Authority for Personal Data, SPARTAN will continue to comply with its obligations under Law no. 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data, as amended and supplemented.

SPARTAN is obliged to manage in a secure manner and only for the specified purposes, the personal data that the USER provides about himself.

Collection and processing of personal data
The protection of information during the processing of the USER’s personal data is a major concern for SPARTAN. Therefore, SPARTAN aims to provide a safe online experience, respecting the USER’s rights.

SPARTAN does not encourage SPAM, does not provide the USER’s email address to third parties (natural or legal persons), does not sell, offer, exchange email addresses obtained through this site, does not disclose the USER’s email address to other persons accessing the pages of this site, without the explicit consent of the USER. Any USER who has explicitly provided his/her email address on the site may opt to have it deleted from the database. SPARTAN will not carry out commercial communications by electronic mail, unless the USER has previously expressed his/her express consent to receive such communications.

Any person who visits the site and who provides personal data or information through this Site expressly and unequivocally agrees to the use of the data provided for the purposes mentioned below.

Personal data will only be stored if provided voluntarily by the USER, for example, in the context of completing a form, an opinion poll or during the execution of a contract (such as contracting a service).

The nature of the requested information refers, in particular, to personal data (name, surname, telephone numbers, e-mail address), but may also include other information closely related to making an appointment or providing feedback on the services offered by SPARTAN.

The completion by the USER of the forms on the site is equivalent to the unconditional acceptance that the data provided through these forms be included in the SPARTAN database and with the use and processing by SPARTAN and its collaborators for the performance of processing activities and provision of services for organizing seminars on topics of entrepreneurial education and / or management, economic – financial management, marketing and advertising, statistics, as well as for electronic communications services (via email, SMS or telephone).

The termination of the personal data processing operation can be done in the following ways:

processing for another purpose, with the consent of the data subject;
deletion, destruction, archiving.
Measures taken to ensure the security of personal data processing
SPARTAN guarantees the security and confidentiality of data hosted and transmitted through its computer system, but does not assume responsibility for the loss of information caused by any malfunctions or errors in the software it is equipped with and which is provided by third-party software companies. Although SPARTAN has taken security measures to prevent data loss, incorrect or inappropriate use and unauthorized access, the absolute security of data transferred over the Internet cannot be guaranteed.

Any modification of personal data can only be made by specially designated authorized users.

During user training courses, the operator informs them about the provisions of Law no. 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data, to the minimum security requirements for the processing of personal data, as well as to the risks involved in the processing of personal data.
Users who have access to personal data are trained by the operator on confidentiality. Users are required to close their work session when they leave their workplace.
Any personal data printed in physical format will be stored and archived in a locked room with restricted access.
In order to maintain the security of the processing of personal data (in particular against computer viruses), the operator takes measures consisting of:
prohibiting the use by users of software programs that come from external or dubious sources;
informing collaborators who have access to the databasedata regarding the danger of computer viruses;
implementation of automatic virus removal and computer system security systems;
Data encryption using an SSL security certificate to encrypt information circulating through Internet channels between the site and its USER.
SPARTAN makes all reasonable, commercially justified efforts to protect the personal data collected, analyzing new technologies in the field and then, if necessary, applying them in order to upgrade its security systems.

Use and disclosure of personal data and specification of the purpose
The information that the USER provides will be treated in accordance with current legislation on Personal Data Protection and will be used by SPARTAN for the following purposes:

invoicing the ordered services;

evaluation of the services provided;
direct marketing, namely information via e-mail messages regarding services, promotions or any other marketing actions carried out by SPARTAN and its partners and administration of the customer (consumer) database, only to the extent that the data subject has expressed his/her express and unequivocal consent to the processing of the e-mail and/or telephone for this purpose;
conducting market studies, monitoring consumer behavior;
processing and resolving by SPARTAN of requests, questions and complaints addressed (see the “CONTACT” section displayed on the Site);
other activities undertaken by SPARTAN and permitted by law, which are not subject to approval by the recipient.
Thus, SPARTAN undertakes not to make public the personal data transmitted by the USER through the Site, not to market them and not to disclose them to third parties, without the prior consent of the USER.

SPARTAN may disclose personal data to third parties if required by law or in good faith cases to comply with legal provisions. When SPARTAN is requested to provide personal data in legal situations, only those data necessary to strictly fulfill the purpose of the request will be disclosed.

According to the requirements of Law no. 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data, as amended and supplemented, SPARTAN is obliged to manage in safe conditions and only for the specified purposes, the personal data that the USER provides.

By completing the data in the form provided by SPARTAN, the USER declares and unconditionally accepts that his/her personal data be included in the SPARTAN database and gives his/her express and unequivocal consent that all such personal data be stored, used and processed by SPARTAN, the entities forming the SPARTAN brand and their collaborators for the performance and/or development by SPARTAN, the entities forming the SPARTAN brand and their collaborators of activities such as, but not limited to, commercial activities, product and service promotion, marketing, advertising, media, administrative, development, market research, statistics, sales tracking and monitoring and consumer behavior. The USER also gives his/her express and unequivocal consent that these personal data may be transferred (ceded) by SPARTAN to the entities forming the SPARTAN brand.

User rights to access personal data
The USER and all persons who transmit personal data to the site are guaranteed the rights in accordance with the provisions of Law 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data, as amended and supplemented.

By reading the Privacy Policy, the Personal Data Protection Policy and the “Terms and Conditions” of this Site, the USER has become aware that he is guaranteed the rights provided for by law, namely the right to information, the right to access data, the right to intervene in data, the right to object, the right not to be subject to an individual decision, the right to seek justice and the free movement of such data. At the same time, he has the right to oppose the processing of his personal data and to request their updating, total or partial deletion.

The USER may exercise, free of charge and without any justification, any of the rights listed above, as follows:

the right to information, namely SPARTAN is obliged to provide information regarding the identity of the personal data controller, the purpose for which the data is processed, whether the provision of all data is mandatory and the consequences of refusing to provide them, as well as the existence of the rightthe rights it has;
the right of access, namely SPARTAN has the obligation to confirm to the applicant whether or not it processes personal data, free of charge, within the limit of one request per year, based on a written request, dated, signed and sent to the address office@hotelmandachi.com; it also has the right to consult the register of records of personal data processing, to file a complaint with the supervisory authority, but also to challenge the operator’s decisions, in accordance with the legal provisions.
the right of intervention on data, namely SPARTAN has the obligation to rectify, update, block, delete or transform into anonymous data, free of charge, data whose processing does not comply with the provisions of Law no. 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data, as amended and supplemented;
the right not to be subject to an individual decision;
the right to address the courts;
the right to object to the processing of personal data concerning him or her and to request the deletion of personal data. Any person has the right to object, for legitimate reasons, to the processing of data concerning him or her.
SPARTAN may also provide the USER’s personal data to other companies with which it has a collaboration relationship, as well as to entities that make up the SPARTAN brand, but only on the basis of a confidentiality commitment from them, guaranteeing that this data is kept safe and that the provision of this personal information is made in accordance with the legislation in force.

SPARTAN undertakes not to expressly request personal data related to the health of users through its contact form.

In the event that by completing the data in the contact form made available by SPARTAN, the USER also communicates data related to his or her health to SPARTAN, this is done only on the basis of his or her free will.

USE OF COOKIES
The User understands and accepts that SPARTAN may collect and store statistical and anonymous data, without identifying the persons visiting this Site.

When visiting the Site, the web server automatically records data such as the name of the USER’s internet service provider and the website from which the visit is made. This data is anonymous, without any association between it and the USER’s personal data.

In order to improve the online browsing experience and to ensure that the service is relevant to the USER’s needs, the Site uses cookies and the Google Analytics web analysis service (owned by Google Inc.). Google Analytics collects and processes statistical information to evaluate the USER’s use of the site and to draw up reports on site activity. To collect this data, Google uses cookies, but the IP address transmitted by the browser from which you access the Site in Google Analytics will not be associated with other data held by Google or by SPARTAN.

SC STRONG MND CORPORATION SRL is not responsible and will not be liable for the infection of a USER/CLIENT’s computer with computer viruses, for cyber attacks of any kind, for the loss of the USER/CLIENT’s data from their devices or the damage to any hardware or software belonging to them and is not responsible for phishing emails or for the partners’ links that may appear at any time on the website.

APPLICABLE LAW. JURISDICTION
These Terms and Conditions, as well as the Contract, are subject to the provisions of Romanian law. In case of disputes, they will be resolved by the competent court at the headquarters of SC STRONG MND CORPORATION SRL, the USER/CLIENT expressly expressing his/her agreement regarding this choice of jurisdiction.
